The rules of the band.
iHertz is a public radio band made of strangers’ voices. You record short voice notes; other people find them by turning a dial, and may answer once; answers become short conversations that take turns. These terms are the agreement between you and us about using it. By creating an account you accept them, and the privacy policy with them.
iHertz is run by Vu Tran, in Vietnam (“we”).
Who can use iHertz
- You must be 18 or older. By creating an account you confirm you are.
- You sign in with Google or Apple. The account is yours alone: do not let anybody else use it, and do not make another to get around a removal.
- You can listen without an account. Recording, answering and replying need one.
What you may not say
iHertz has zero tolerance for objectionable content and abusive users. Do not record, publish, send or title anything that is:
- threatening, harassing, bullying or abusive, or that encourages anybody to hurt themselves or somebody else;
- hateful or discriminatory toward anybody for who they are — race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability, or anything like them;
- sexually explicit — and anything sexual involving a minor, which we report to the authorities;
- violent or graphic in a way meant to shock;
- illegal, or promoting something illegal;
- impersonating somebody, or pretending to be somebody you are not in order to deceive;
- somebody else’s private information — a name, an address, a number, anything that would let people find or identify them;
- a recording of somebody who did not agree to be recorded, or of a child;
- spam, advertising, scams, or a way to lure people somewhere else;
- somebody else’s work that you do not have the right to share.
Keep your own details out of it too — secrets, passwords, money, where you live. And do not try to break, overload, scrape or take apart the service, to find out who is behind a signal, or to get around a limit, a mute or a removal.
Reporting and blocking
- Report any signal or reply from the app. A reported signal comes off the band for everybody at once while it waits to be reviewed, and you will not hear it again, whatever the outcome. Reporting a reply also blocks the person who sent it.
- Block a person from the app. It works both ways: neither of you will hear the other's signals or be able to answer them, and any conversation between you ends for both of you.
- Mute a signal to stop hearing it yourself, and delete any conversation you are in to end it for both of you.
- For anything urgent, or anything the app cannot report, write to hello@ihertz.app.
What we do about it
Reports are reviewed by moderators, and we aim to act on every report within 24 hours. Content that breaks these terms is removed — the recording is erased — and so is the account that posted it. We may also remove content or accounts we find ourselves, limit what an account can do, or keep a signal off the band while we look into it. Every action a moderator takes is logged.
What you record
- What you record is yours, and you are responsible for it. You confirm you have the right to publish it, including the agreement of anybody else whose voice is in it.
- So that iHertz can work, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and play what you record and the titles you give it — including working out its frequency and waveform, putting it on the band, delivering it in conversations, and showing a signal’s title and waveform on its link. The licence lasts as long as the recording is on iHertz, and afterwards only for as long as we need it for safety or the law. It is only for running iHertz, moderating it and keeping it safe.
- A recording can be heard by people you do not know, who can remember it or record it on another device. We cannot stop that, so do not say anything you could not stand to have kept.
Conversations
You may answer a signal once. A conversation takes turns — nobody speaks twice in a row — and has a limited number of them. Either person may delete it at any time, for both.
Your account
- Your handle is assigned, not chosen, and cannot be changed.
- You can sign out, or delete your account from You in the app. Deleting erases it and everything in it, as the privacy policy sets out.
- We may suspend or remove an account, with or without notice, if it breaks these terms, if the law requires it, or to protect people or the service.
No warranty
iHertz is provided as it is and as available. We do not promise that it will always work, that any signal will be heard or answered, or that what other people say is true, lawful or kind: they are responsible for what they say. iHertz is not an emergency service — if somebody is in danger, call your local emergency number.
As far as the law allows, we are not liable for indirect or consequential loss, or for what other people say or do on iHertz. Nothing here takes away a right the law gives you that cannot be taken away.
The app stores
These terms are between you and us, not Apple or Google, who are not responsible for iHertz or anything on it. If you got the app from the App Store, Apple’s standard licensed application end user licence agreement applies as well.
Changes, and the law that applies
When these terms change, the date at the top changes with them, and if a change matters we will tell you in the app before it applies. These terms are governed by the laws of Vietnam, and the courts of Vietnam decide any dispute about them.
